Supreme Court halts Trump administration’s deportation of Venezuelans under Alien Enemies Act temporarily

The Supreme Court issued an order telling the Trump administration not to deport alleged Venezuelan gang members in Texas while litigation is ongoing. The order, which affects detainees in the Northern District of Texas, paused the case and directed the government not to remove any members of the putative class until further notice. Two conservative justices disagreed with the decision. The detainees are being held in the Bluebonnet Detention Center in Anson, Texas, and the administration is seeking to deport them under the Alien Enemies Act. The American Civil Liberties Union filed a request with the Supreme Court to prevent the detainees from being sent to a prison in El Salvador before due process is afforded. The Supreme Court’s previous decision stated that individuals being deported under the Alien Enemies Act must be given the opportunity to challenge the decision through habeas corpus petitions. The case raises concerns about Trump’s use of presidential power in invoking the 18th-century law and whether the administration is complying with court orders. A separate case involves the mistaken deportation of Kilmar Abrego Garcia to El Salvador by the Trump administration.
