Newsmax settles with Smartmatic for $40 million

Newsmax agreed to pay Smartmatic $40 million in a settlement last year following a defamation lawsuit related to false claims about the 2020 presidential election. The settlement included a cash payment and an option to purchase stock in Newsmax. Details of the payments were not publicly available until now, providing insight into the confidential agreement. Smartmatic settled a similar lawsuit against One America News in April for an undisclosed amount.

Newsmax stated that the settlement would eliminate future legal expenses related to the suit, including potential costly appellate actions. After the settlement, Newsmax acknowledged that allegations about Smartmatic altering the election results were false. Smartmatic’s external lawyer, J. Erik Connolly, stated that the company is now focused on a similar case against Fox News.

Fox Corp. reached a settlement in 2023 to pay $787.5 million to Dominion Voting Systems to settle defamation claims related to the 2020 election. Newsmax’s settlement with Smartmatic sheds light on the legal consequences for news outlets that spread misinformation about election integrity. Smartmatic is continuing to pursue legal action against Fox News, aiming to hold the outlet accountable for its actions.
