The American Civil Liberties Union and immigration legal aid groups have filed a lawsuit against the Trump administration over the proclamation of an “invasion” at the southern border. The lawsuit argues that the proclamation, which justifies expelling migrants and preventing them from claiming asylum, is an unprecedented power grab that puts lives in danger. Filed in U.S. District Court for the District of Columbia, the suit contends that President Trump’s use of section 212(f) of the Immigration and Nationality Act circumvents asylum protections granted by Congress to migrants already on U.S. soil. The suit also argues that the rapid deportations of migrants and the suspension of entry without legal status harm the legal aid work of the plaintiff organizations. The ACLU, National Immigrant Justice Center, Texas Civil Rights Project, and others filed the suit on behalf of the legal aid groups. The lawsuit seeks to challenge the administration’s actions and protect the rights of asylum seekers facing persecution or torture.
