A federal court panel upheld a lower court’s decision to strike down the legality of the DACA program, which protects over half a million immigrants who entered the US as children from deportation. Despite this, the program will continue for now as the judges await a likely appeal to the Supreme Court. The ruling stated that the DACA program violated the Immigration and Nationality Act. The decision only applies to Texas, the state leading the lawsuit against DACA. The panel also allowed the government the option to appeal. President Trump had previously attempted to end the program but expressed willingness to work with Democrats to find a solution. The ruling allows current DACA recipients to renew work permits but does not allow new applicants. The court’s decision comes after arguments presented in October by the Justice Department, New Jersey, and an immigration rights group, challenging the legality of the Biden administration’s final rule to codify DACA.
