Montana House approves ban on transgender individuals using specific bathrooms, including lawmakers


Montana’s Republican-controlled House endorsed a ban on transgender people using bathrooms that do not align with their sex assigned at birth. The move, which would complicate daily life for transgender lawmakers Zooey Zephyr and SJ Howell, comes after a more narrow rule targeting Zephyr was rejected. Zephyr and Howell argued against the ban, stating that there is no evidence to support claims that transgender people are a threat to women. Despite strong Democratic opposition, Republicans pushed the bill through in a party-line vote. The measure, supported by Governor Greg Gianforte, would prevent trans people from using restrooms, changing rooms, and sleeping areas based on their gender identity in public buildings.

Zephyr warned that the bill’s legal component could lead to dangerous situations in public facilities. Some Republicans, including Rep. Brad Barker, voted for the bill while expressing concerns about its provisions. Howell argued that the bill goes against Montana values of love thy neighbor and mind thy business. The bill faces a final House vote before heading to the state Senate.

This action in Montana follows similar moves elsewhere, including in Congress where the first transgender member, Rep. Sarah McBride, is restricted from using certain restrooms. Zephyr, who was previously silenced and sanctioned by Republican colleagues, made her return to the House floor two years later. She and Howell continue to fight against discriminatory legislation against transgender people.
